adopts new rules

Braybourne, like many other
subdivisions, was built in phases. All nine phases have separate paperwork and
legal documents associated with them that were filed with DeSoto County.
Braybourne also had two developers, Keystone LLC and Reeves- Williams, and
different attorneys filing the documentation with the county. As a result, the
Restrictive Covenants filed for the nine phases contain inconsistencies amongst
themselves. One of the board’s biggest challenges has been how to unify these
rules, and make them both fair and effective for all homeowners. We consulted
our attorney, and he decided the best route was for the Architectural Committee,
which is empowered by the By-Laws of Braybourne Subdivision, to develop a new
set of guidelines that covers all lots within the entire subdivision. The
committee went to work to get these written and finalized, they were presented
to the entire Board of Directors, and they were unanimously approved at our
August meeting. Below is a copy of the new Architectural Rules of Braybourne Subdivision
available for download for your review and reference. As most of you will
notice, they are very similar to the old Restrictive Covenants, with a few
alterations and some modernization. They can be expanded in the future, as
needed, by the Architectural Committee. They went into effect August 11, 2008 .

Special Note for homeowners planning to improve upon their property:
It is a requirement of the covenants and restrictions that are a part of every Braybourne property deed that all construction, repairs, alterations and renovations that affect
the exterior appearance of property be reviewed and approved by Braybourne Homeowners' Association before the project is undertaken. This applies to any structure, outbuilding, fence
or wall. It includes changes to all exteriors including roofing and siding, paint colors and finishes. Major changes to landscaping, drives and parking areas and other proposed
property improvements must also be reviewed and approved before the project is undertaken.
A new
standardized Building Permit Request form is available for download! When
complete, this form gives the ABGCA committee all the information necessary to
properly analyze and provide a decision for your project.

In addition to a description of the project, submitted plans must show the intended location on the property,
exterior elevations of structures, architectural details, materials and finish colors of all exterior surfaces.
Approval/disapproval letters will normally be issued within fourteen days of receipt of documents for review.
Submission of your plans to the Association is in addition, and should be submitted prior to any plans submitted to Desoto County.
If your project has been approved, you must then submit your letter of approval along with a completed Application for Variance to the Desoto
County Planning and Building Department, as well as any additional documents or fees the county requires from you to substantiate the application process.
